TUFIT - TERMS OF USE

1. SCOPE

These Terms of Use apply to your use of the TuFit iOS app. By installing and using the app, you agree to these Terms of Use. If you do not agree, do not download or use the app.


2. SCOPE OF SERVICES

Free version:
TuFit's free version includes calorie tracking with manual entry, a barcode scanner with access to food databases, 1 AI photo scan of nutrition labels per day, a food diary with 7 days of history, and a personal calorie plan based on your onboarding information.

TuFit Pro (paid subscription):
The Pro subscription includes unlimited AI photo scans, unlimited history and progress overview, a personalized nutrition plan, and Apple Health synchronization.


3. PRICES AND SUBSCRIPTION

TuFit Pro is available as a subscription at the following prices (incl. VAT where applicable):

- TuFit Pro Monthly: $7.99 per month
- TuFit Pro 3 Months: $19.99 per quarter (approx. $6.66 per month)
- TuFit Pro Yearly: $59.99 per year (approx. $5.00 per month)

All payments are processed via Apple In-App Purchase and managed by RevenueCat. Payment is made through your Apple account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period. You can manage and cancel your subscription in iPhone Settings under Apple ID → Subscriptions.


4. RIGHT OF WITHDRAWAL

For digital content that can be used immediately after purchase, the right of withdrawal expires when performance of the contract begins, provided you have expressly agreed that we may begin performance before the withdrawal period ends. Refund requests must be submitted directly to Apple in accordance with Apple's refund policy.


5. AI NUTRITION VALUES - DISCLAIMER

Nutrition values determined by AI photo analysis are estimates and may contain errors. TuFit accepts no liability for the accuracy of AI-generated values. Do not use this feature as a basis for medical or dietary decisions. For health-related questions, consult a physician or dietitian.


6. USER OBLIGATIONS

You agree not to misuse the app. In particular, you must not use the app for illegal purposes, circumvent security mechanisms, perform automated access (bots, scraping), reverse engineer the app, or share your login credentials with third parties.


7. AVAILABILITY AND CHANGES

We strive to keep the app highly available but do not guarantee uninterrupted operation. We reserve the right to change, expand, or discontinue features. Material changes to these Terms of Use will be announced at least 30 days before they take effect.


8. LIMITATION OF LIABILITY

TuFit is not liable for damages arising from use of the app unless caused by intent or gross negligence. The app does not replace medical advice. This does not apply to damages resulting from injury to life, body, or health.


9. APPLICABLE LAW AND JURISDICTION

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with merchants is Kulmbach, Germany.
